Veterans Affairs proposes schedule for T4NG2 case

Lawyers representing the Veterans Affairs Department have proposed a schedule for hearings and filings involving the almost three dozen protests against the agency’s award of the T4NG2 contract.

The 32 protesters support VA’s proposed schedule, which has not been accepted yet by the U.S. Court of Federal Claims judge overseeing the case.

VA's proposal includes a recommended end date of March 28, 2025 for a final decision by the judge.

Between now and then there are several due dates for motions, supplemental motions and responses to motions.

If accepted, the first deadline would be June 7. Protesters would need to file motions to supplement and/or complete the administrative record.

By June 24, protesters must file amended complaints. By July 3, VA and the intervenor-defendants must file their motions to dismiss.

The proposed schedule recommends oral arguments for Aug. 13 and 14.

After oral arguments, there is another set of deadlines for cross motions and responses for motions. VA's lawyers want the judge to rule on the motions to dismiss by Sept. 12.

Assuming the case continues to move forward, the proposed schedule sets dates for more filings before the final oral arguments on Feb. 12 and 13, 2025. Then the judge would make a ruling on March 28, 2025.

VA's Transformation Twenty-one Total Technology Next Generation 2 contract is the department’s primary vehicle for acquiring IT services and solutions. VA has named 30 winners with half of those being small businesses.

The protesters are challenging VA’s use of a self-scoring methodology and how the department verified those self-scores.
