More full-blown competitions are coming to the Defense Department now that final rules have been released implementing Section 803 of the 2002 National Defense Authorization Act.

The rules call for contracting officers to contact as many contractors as practical when issuing service orders worth more than $100,000. The rule applies to all orders issued under multiple-award contracts.

If less than three contractors respond, the contracting officer must determine in writing that no additional qualified contractors were identified despite reasonable efforts to do, said Deidre Lee, director of defense procurement.
